Conditions
These Terms govern your access to and use of Aucot’s website, applications and AI-powered creative services. By creating an account, purchasing a subscription or using the Services, you agree to these Terms.
1. Agreement and eligibility
These Terms & Conditions (“Terms”) form a binding agreement between you and Volion's Bilişim ve Reklam Teknolojileri, operating as Aucot (“Aucot,” “we,” “us,” or “our”), regarding the Aucot website, mobile applications, APIs, AI generation tools and related services (collectively, the “Services”). Our Privacy Policy explains how we handle personal information and is incorporated by reference where permitted by law.
You must be at least 13 years old and meet any higher minimum age required in your country. If you have not reached the age of legal majority, a parent or legal guardian must review and agree to these Terms on your behalf. If you use the Services for a company or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.
If you do not agree to these Terms, do not access or use the Services.
2. The Services
Aucot provides AI-assisted tools that may generate or edit marketing text, product scenes, model imagery, logos, social content, video, backgrounds and enhanced media. Features, models, limits, supported formats and availability may change over time. Some features may be experimental, identified as beta, or available only to specific plans, devices or regions.
We may update, improve, replace, suspend or discontinue a feature when reasonably necessary for product development, security, legal compliance, provider availability or technical reasons. Where a change materially reduces a paid Service, we will provide notice when reasonably practicable and any remedy required by applicable law.
3. Accounts and security
- You must provide accurate information and keep it current.
- You are responsible for activity conducted through your account and for keeping credentials, devices and sign-in methods secure.
- You may not share, sell, rent or transfer an account, or create accounts through automated or deceptive means.
- You must promptly notify us at hello@aucot.com if you suspect unauthorized access.
We may require additional verification to protect your account, process a privacy request, restore purchases or investigate suspicious activity. We are not responsible for losses caused by your failure to secure your account, except where liability cannot legally be excluded.
4. Plans, usage and subscriptions
Free and paid access
The Services may include free usage and paid subscription plans. Each plan may include separate allocations for creative generation, chat, image features, video time or other resources. The applicable price, billing period, feature set and limits are displayed before purchase.
Usage measurement
Different actions may consume different amounts of usage based on processing cost, duration, resolution, model or feature. Usage may renew on a weekly, monthly or other schedule described in the purchase interface. Unless expressly stated, unused usage does not roll over, has no cash value and cannot be transferred between accounts.
Automatic renewal
Paid subscriptions automatically renew at the end of each billing period unless canceled before renewal. By purchasing a subscription, you authorize the applicable payment provider or app store to charge the then-current subscription price and applicable taxes using your selected payment method.
Price changes
We may change subscription prices or plan contents. Price changes will apply no earlier than your next renewal after any notice required by law or the payment platform. You may cancel before the new price takes effect.
Cancellation and refunds
You can cancel through the platform or account settings used for purchase. Cancellation turns off future renewal; unless the purchase platform states otherwise, access continues until the end of the current paid billing period. Deleting the app or your Aucot account does not itself cancel a subscription.
Refund eligibility is determined by applicable law and the rules of the platform that processed the purchase. For App Store purchases, cancellation is managed through your Apple Account and refund requests are handled by Apple. For purchases made through another payment provider, use the account or support flow shown at checkout. Nothing in this section limits a mandatory cancellation, withdrawal or refund right.
5. Your content and permissions
“Input” means prompts, photographs, video, audio, logos, documents and other material you submit. “Output” means content generated or modified through the Services in response to your Input. Together, Input and Output are “User Content.”
Your responsibility
You represent and warrant that you own or have all rights, permissions and lawful bases needed to submit Input and direct us to process it. You are responsible for User Content and for ensuring that its creation, use and publication comply with law, third-party rights and these Terms.
License to operate the Services
You grant Aucot and its service providers a worldwide, non-exclusive, limited license to host, copy, transmit, transform and otherwise process User Content solely as necessary to provide, secure, maintain and improve the Services; comply with law; and enforce these Terms. This license ends when the content is deleted from our active systems, except for limited backup, legal and security retention.
Output rights
As between you and Aucot, and to the extent permitted by applicable law, you retain rights in your Input and own the Output generated specifically for you. Aucot assigns to you any rights it may have in that Output. This does not grant rights in third-party material, Aucot technology, models, interface elements, templates made available under separate terms or content generated for other users.
Because AI systems can produce similar results, Output may not be unique. Other users may receive content that resembles your Output, and you receive no rights in their content.
6. AI-specific terms and review obligations
AI-generated material can be incorrect, incomplete, unexpected or unsuitable. It may contain artifacts, inaccurate text, implausible details or similarities to existing material. You must independently review Output before relying on, publishing, selling or using it in advertising.
- Do not treat Output as professional legal, medical, financial or other regulated advice.
- Verify factual claims, product representations, pricing, testimonials, disclosures and advertising compliance.
- Review Output for trademarks, copyright, publicity rights, privacy, cultural sensitivity and platform rules.
- Do not misrepresent AI-generated people, events or endorsements as real.
- Use any required label or disclosure when law or a publishing platform requires identification of synthetic content.
Aucot does not guarantee that Output is accurate, unique, non-infringing, eligible for intellectual-property protection, or suitable for a particular purpose.
7. Acceptable use
You may not use the Services to create, upload, request, distribute or facilitate:
- illegal activity, fraud, scams, phishing, malware or unauthorized access;
- sexual exploitation, content involving minors, non-consensual intimate imagery or sexual deepfakes;
- credible threats, targeted harassment, hateful abuse or instructions that materially facilitate violence;
- deceptive impersonation, forged endorsements or misleading synthetic media likely to cause harm;
- content that infringes intellectual property, privacy, publicity or other third-party rights;
- automated scraping, reverse engineering, model extraction, security testing without authorization or circumvention of usage limits;
- resale, sublicensing or provision of the Services to third parties unless expressly authorized in writing; or
- activity that overloads, disrupts or damages the Services or interferes with another user.
We may use automated and manual measures to detect prohibited conduct. We may block a request, remove content, limit functionality or suspend an account when reasonably necessary to protect users, third parties or the Services.
8. Aucot intellectual property
The Services, including software, interfaces, workflows, designs, text, graphics, trademarks, logos, models, documentation and underlying technology, are owned by or licensed to Aucot and are protected by intellectual-property laws. Subject to these Terms, Aucot grants you a limited, personal, non-exclusive, non-transferable and revocable right to use the Services during the applicable access period.
No right is granted to copy, modify, distribute, sell, lease, reverse engineer or create derivative works from the Services except where applicable law does not permit that restriction. “Aucot” and associated marks may not be used without prior written permission.
Feedback
If you submit suggestions or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use it without restriction or compensation, provided we do not publicly identify you as the source without permission.
9. Third-party services
The Services may rely on or link to third-party products, models, hosting, authentication, payment, app-store or content delivery services. We do not control third-party services and are not responsible for their independent terms, availability or conduct. Your use of them may be subject to additional terms.
10. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Aucot disclaims all express, implied and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability and uninterrupted or error-free operation.
We do not guarantee any particular marketing result, engagement, conversion, revenue, ranking, approval by a platform, intellectual-property registration or commercial outcome. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
11. Limitation of liability
To the maximum extent permitted by law, Aucot and its affiliates, officers, employees and providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, goodwill, data or business opportunities, arising from or related to the Services, even if advised that such damages are possible.
To the maximum extent permitted by law, Aucot’s total aggregate liability arising from or relating to the Services will not exceed the greater of: (a) the amount you paid to Aucot for the Services during the twelve months before the event giving rise to the claim; or (b) US$100. These limitations do not apply to liability that cannot legally be limited, including where applicable for fraud, willful misconduct, death or personal injury caused by negligence, or mandatory consumer rights.
12. Indemnity
To the extent permitted by law, if you use the Services on behalf of a business, you will defend, indemnify and hold harmless Aucot and its affiliates, officers, employees and providers from third-party claims, damages, liabilities and reasonable costs arising from your User Content, your commercial use of Output, your violation of these Terms or your infringement of another party’s rights. This obligation does not apply to the extent a claim results from Aucot’s own violation of these Terms or applicable law.
13. Suspension and termination
You may stop using the Services at any time and may request account deletion. Deleting the app does not automatically cancel a subscription.
We may restrict, suspend or terminate access if you materially or repeatedly violate these Terms; create risk or legal exposure; fail to pay; abuse usage systems; or threaten the security, integrity or availability of the Services. Where appropriate, we will provide notice and an opportunity to remedy the issue. We may act immediately when necessary to prevent harm, comply with law or respond to a security incident.
Sections that by their nature should survive termination—including content responsibility, intellectual property, disclaimers, liability, indemnity and dispute provisions—will continue to apply.
14. Resolving disputes
Before filing a formal claim, you and Aucot agree to attempt in good faith to resolve the dispute by written notice to hello@aucot.com describing the issue and requested resolution. This informal process does not prevent either party from seeking urgent injunctive relief or using a small-claims process where available.
Any dispute will be handled under the laws and before the courts that have jurisdiction under applicable law. If you are a consumer, you retain the benefit of any mandatory protections and forums available in the country where you live.
Nothing in these Terms limits mandatory rights or remedies available to consumers under applicable law.
15. General provisions
- Changes: We may update these Terms. Material changes will be notified as required, and continued use after the effective date constitutes acceptance where legally permitted.
- Assignment: You may not assign these Terms without our consent. We may assign them in connection with a reorganization, merger, acquisition or sale of assets.
- Severability: If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain effective.
- No waiver: Failure to enforce a provision is not a waiver.
- Entire agreement: These Terms, the Privacy Policy and purchase-specific terms form the entire agreement regarding the Services.
- Electronic communications: You agree to receive agreements, notices and records electronically where permitted by law.
